Terms of Service

MLSBLAST is a technology platform designed to help licensed real estate professionals create marketing materials and promotional communications for listings they are authorized to promote.

The platform provides tools that allow users to generate listing marketing campaigns, including agent-to-agent communications, marketing flyers, and optional promotional content that may be shared through professional marketing channels.

Where enabled by the user, MLSBLAST may assist agents in publishing promotional content to designated MLSBLAST social media channels to help increase visibility for the listing.

All marketing activity is initiated or authorized by the listing agent or brokerage. MLSBLAST operates solely as a technology provider and does not independently market or advertise MLS listings without agent authorization.

The Service is intended for use by:

• Licensed real estate professionals
• Real estate brokerages
• Real estate industry participants authorized to promote property listings

By using the Service, you represent that:

• You are legally authorized to promote the listings you submit
• You comply with the policies of your brokerage and applicable MLS rules
• All information submitted through the platform is accurate

Users of the Service agree that they will:

• Promote only listings they are authorized to market
• Ensure listing information provided is accurate
• Comply with MLS rules and applicable real estate regulations
• Maintain proper brokerage attribution where required

Users may not use MLSBLAST to:

• Promote listings without authorization
• Misrepresent property information
• Violate MLS rules or brokerage policies
• Engage in unlawful or misleading marketing practices

MLSBLAST may integrate with Multiple Listing Services (“MLS”) through authorized data feeds where permitted. All MLS listing data remains the property of the respective MLS organization.

Users acknowledge that:

• MLS data may only be used in accordance with applicable MLS licensing agreements
• MLSBLAST does not grant ownership rights to MLS data
• MLS organizations may impose additional restrictions on data use

You acknowledge that the individual multiple listing service (MLS®), which supplies the listing data, owns such data and you acknowledge the validity of the MLS’s copyright to such data.

MLSBLAST also explicitly authorizes MLS® employees, MLS® members, or their duly authorized representatives to access MLSBLAST's website for the purposes of verifying compliance with MLS® rules and monitoring the display of Participants’ listings on MLSBLAST apps.

MLSBLAST reserves the right to suspend or modify access to MLS data if required by an MLS organization or licensing agreement.

MLSBLAST provides marketing tools that allow agents to generate promotional content for listings they are authorized to promote.

Where enabled by the agent, MLSBLAST may assist in publishing promotional posts on designated MLSBLAST social media channels. Such posts are created using listing information submitted or authorized by the listing agent or brokerage.

MLSBLAST does not independently advertise or market MLS listings and does not publish listing content without agent authorization. Brokerage attribution and MLS copyright notices may be included where required by applicable MLS rules.

MLSBLAST operates under the supervision of licensed real estate brokerages. Agents may only promote listings they are authorized to market under their brokerage policies.

Brokerages or MLS organizations may request removal or modification of listing content appearing within MLSBLAST at any time by contacting: compliance@mlsblast.com. MLSBLAST will review and respond to such requests promptly.

The MLSBLAST platform, including its software, design, and underlying technology, is the intellectual property of MLSBLAST and is protected by applicable intellectual property laws.

Users may not:

• Copy or reproduce the platform
• Reverse engineer the software
• Resell or redistribute the Service without authorization

MLSBLAST may integrate with third-party services or data providers, including MLS systems, marketing platforms, and communication services. MLSBLAST is not responsible for the availability, accuracy, or performance of third-party services.

The Service is provided “as is” and “as available.”

MLSBLAST makes no warranties regarding:

• Uninterrupted operation of the Service
• Delivery performance of marketing campaigns
• Accuracy of listing information provided by users or third-party data sources

Users are responsible for verifying listing information independently.

To the maximum extent permitted by law, MLSBLAST shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of the Service.

MLSBLAST reserves the right to suspend or terminate user accounts that:

• Violate these Terms
• Misuse the platform
• Violate MLS rules or data licensing agreements

Users may discontinue use of the Service at any time.

MLSBLAST may update these Terms from time to time. Updated versions will be posted on this page with the revised effective date. Continued use of the Service after updates constitutes acceptance of the revised Terms.

These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, United States.
